Abstract

Background. The author briefly analyses two concomitant problems inherent to the Russian system of constitutional justice. The first problem embraces federative relations within constitutional control. The federative dimension has two interrelated aspects. Firstly, it signifies the problem of vertical cohabitation of two levels of constitutional justice in Russia. Secondly, it questions the problem of horizontal variety and differentiation of regional constitutional adjudication system. The second problem may be circumscribed as an uneasy and inconsistent return of Russia into the European civil law system. The author argues that the Russian legal order has not managed to complete the genuine come back into the civil law family so far. The Russian constitutional adjudication system is haunted by the “ghost of administrative justice”. Due to the absence of administrative courts the constitutional and statutory courts in Russia often have to tackle problems, which lack the character and significance of constitutional law.
Materials and methods. Article is constructed on the basis of the analysis of decisions of the constitutional and statutory courts of territorial subjects of the Russian Federation. The main research methods were legallistic and comparative-legal ones.
Results. The research of questions of subfederal constitutional control in the Russian Federation has defined, that the return of Russia to the romanic-german legal system remains incomplete.
Conclusions. The constitutional and statutory courts restrictedly interpret the volume and nature of the competence. The constitutional and statutory courts in territorial subjects of the Russian Federation are careful to concern a perspective of illegality of individual administrative acts, referring to limits of the competence as the spheres only of standard control.
